Sacramento DUI Stop Do's and Don'ts

DUI lawyer advice in Sacramento County and throughout California regarding DUI Stops seems to be the same
.
1. Have your driver's license, insurance and registration ready to hand to the officer before you even start driving, just in case.

2. If you see that you are being pulled over, roll the windows down and let the car air out before the officer approaches your car.

3. Be courteous but admit nothing. If asked if you've been drinking, you might just say, "why do you ask?" or "I'd rather not say". If you're asked if you know why you were pulled over say, "No". The officer will ask a number of other questions to which you should say, "I'd rather not answer any more questions" Don't try to be clever or funny, just say as little as possible. You are not obligated to do anything more than confirm who you are.

4. If the officer tries to check your eyes for Nystagmus, in or outside the car, respectfully decline the test.

5. If you are asked to step out of the vehicle, don't argue, just do it. Do it carefully as the officer is looking to see how your balance is
.
6. Respectfully decline to perform any Field Sobriety Tests on advice of an attorney. There is no penalty for refusing to do these tests.

7. Do not blow into the Preliminary Alcohol Screening (PAS)device, unless you are under 21, on DUI probation, or the officer confirms that the device used is the evidentiary breath test.

8. Do not consent to a search of your vehicle if you are not on searchable probation. If the officer decides to search the car anyway, don’t try to prevent it.

9. If the officer decides to arrest you, be cooperative and know that they likely were going to take you in anyway. If you follow the advice above, the prosecution will have very little other than the officer's observation of your driving and the results of the chemical test you will take at the jail or the police station.

10. You must submit to a Blood or Breath test if the officer believes you are only under the influence of alcohol. If the officer believes you are under the influence of drugs or prescription medications, your choices will be Blood or Urine. In either case, if the test you choose is not available you will have to take the other. Do not refuse the evidentiary test or you will likely lose your driver's license, even if you have no alcohol in your system.
